Plants – 90 days, lights – 1 year, masonry – 2 years, irrigation – 2 years, trellises, gates or other ironwork covered – 1 year for workmanship and installation (does not include standard fading or rust). Artificial turf – 2 years on workmanship/ installation and 10 years pro-rated material replacement (does not include labor or misuse). Turf warranties active with homeowner installation of sunscreen if necessary. Turf will not be warranted for reoccurring crab grass. Warranties only valid if payments are made in accordance to the payment schedule of this contract. Warranties only valid if payment is made in full upon completion. Damages caused by storms, freezing, excessive heat or other acts of God will not be covered. This includes, but not limited to, proper maintenance of plants and products. NO warranty on Ocotillos. Our team will educate homeowners on all care instructions. Once plants & trees are placed and approved by client, any request to relocate/move the plant or tree will void the warranty.
A 10% non-refundable fee will be assessed if the job is cancelled after signing the contract. Additional fees may apply if supplies and/ or materials are purchased with a signed contract. If a signed contract is partially cancelled or any line items removed, a percentage of the total items cancelled will incur a non-refundable fee.
All personal property must be removed by the homeowner, prior to the start of the job. Colorworks Landscaping, LLC nor their affiliates will be held responsible for any damaged items left in or around the vicinity of the job site area. Colorworks Landscaping, LLC nor their affiliates will be responsible for any damaged property that has to be relocated due to homeowners not removing items prior to the start of the job.
Once construction begins; $350 inconvenience fee may be assessed for any and all changes once job begins production. Change orders, additions, alterations and diversions from the design plan will require a signed “job change order” document from both homeowner and designer (not the contractor or foreman). Any additional cost with the change order including the $350 inconvenience fee is due in full upon request to cover all necessary expenses. Unforeseen obstacles are not uncommon and homeowner agrees to cover any additional cost due to any event that may occur. i.e: tree roots, tree stumps, buried hazard material, buried concrete/footings, depth of existing granite, clogged drains etc.
**CONCRETE REMOVAL** estimate covers 4 inches thick without rebar for every additional inch after 4 inches will be priced out at .65 cents per square foot. Contractor will not warranty concrete cracks, including hairline cracks, discoloration or efflorescence. Contractor will not guarantee invasive grass/weeds returning after post emergent (weed and grass killer) treatment has been applied. This includes new lawns.
Natural stone and tile disclaimer;
If your agreement includes the installation of any natural stone pavers, stone veneer or tile, please be aware that all natural stones contain variations in color and patterns, plus imperfections including chips, holes, cracking etc. This is part of the beauty of natural stones. Many of these imperfections will be camouflaged by the sand fill or mortar used in installation. Excessively broken or chipped pieces will be reviewed by designer and customer for replacement. Additional replacement beyond this will be charged at standard rate.
Concrete is a living organism and may change from its original form for up to two years after installation, this includes hairline cracks and discoloration.
Client is responsible for HOA compliance and document submittal. Plan fees are non-refundable. Prices are subject to change based on labor and material costs. All credit card payments are subject to a non refundable 3.5% fee. All pricing is good for 90-days from the date of the initial estimate and are subject to change if not signed in that 90-day time frame.
